Where to find information about us and our products

You can find everything you need to know about us, Furniture Choice (Malaysia) Sdn. Bhd., and our products on our website before you order. We also confirm the key information to you in writing by email.

When you buy from us you are agreeing that:

1. Sometimes we reject orders

Sometimes we reject orders, for example, because a product is unexpectedly out of stock, because your card issuer refuses payment or does not authorise payment, because you are located outside our delivery areas, because the product was mispriced by us or because we reasonably believe that the order is fraudulent. When this happens, we will let you know as soon as possible and refund any sums you have paid.

    2. We charge you when you order

The ownership of the product will be transferred to you once the payment is received in full.

      3. We will compensate you if the delay of your product is substantial

If our supply of your product is delayed by any events outside our control, which includes but not limited to floods, accidents, website breakdowns, stock shortages, and others, we will contact you as soon as reasonably possible to inform you and exercise the best of our capabilities to reduce the delay. In the event the delay of the product is substantial and crucial, we will reimburse you based on the following calculations:

        4. Products can vary slightly from their photos

A product's colour may differ slightly to the photos displayed on our website on your device or its packaging may be slightly different.

          5. Please read our delivery and access terms carefully

            7. You have rights if there is something wrong with your product

7.1 If you think there is something wrong with your product, you must contact our Customer Service Team as soon as you notice the default. We will ask you to provide photographs and may send an independent furniture technician to assess the nature of the fault. We honour our legal duty to provide you with products that are as described to you on our website and that meet all the requirements imposed by law. Your legal rights are summarised below and are subject to certain exceptions.

Summary of your key legal rights

The Consumer Protection Act 1999 states the goods must be as described, fit for purpose and of acceptable quality. During the expected lifespan of your product your legal rights entitle you to the following:

Up to 14 days: if your goods are faulty, then you can get a refund.

Up to 6 months: if your goods are faulty and cannot be repaired or replaced, then in most cases you are entitled to a full refund.

After 6 months: you will be asked to provide evidence that the item is faulty rather than any issue being due to reasonable wear and tear. If the item is faulty, then we may appoint an independent furniture specialist to evaluate suitable options, which may include a repair, replacement or some money back.

7.2 We offer a limited warranty for domestic use. If your product is defective or develops a fault within the relevant time periods, then, subject to the limitations and exclusions, our warranties will apply:

            8. We can end our contract with you

8.1 We can end our contract with you for a product and claim any compensation due to us if:

              1. you failed, within a reasonable time of us asking for it, to provide us or our delivery partners with information, cooperation or access that we need to provide the product; or you failed, within a reasonable time, to allow us to deliver the product to you which includes, but not limited to, circumstances where there are too many reschedules from your part or frequent changes in the delivery address.

              9. We do not compensate you for all losses that falls outside our reasonable control

9.1 We are responsible for losses you suffer caused by our breach of this contract unless the loss is:

              a. Unexpected. It was not obvious that it would happen and nothing you said to us before we accepted your order meant we should have expected it (in other words, unforeseeable events). Unforeseeable events include but are not limited to:

              i. fire, explosion, storm, flood, earthquake, subsidence, or other form of natural disaster
ii. civil commotion, riot, invasion, terrorist attacks, or war or other form of man-made disasters.
iii. Impossibility of use of railways, shipping, aircraft, motor transport or other means of public or private transport

              b. Outside of our control. Caused by a delaying event outside our control. As long as we have taken the steps set out in clause 3 above.

              c. Avoidable. Something you could have avoided by taking reasonable action.

              d. Commercial use of products which has been stated in clause 6.4 above.

              10. We use your personal data as set out in our Privacy Notice

11.2 If you are unsatisfied with how we resolve your issues, you can bring the claim to the Tribunal for Consumer Claims Malaysia.

11.3 If the resolution above is still unsatisfactory. You can exercise your rights to go to court. These shall be governed and construed in accordance with the laws of Malaysia, and you hereby irrevocably submit to the jurisdiction of the courts in Malaysia.

                12. Other important terms apply to our contract

12.1 Nobody else has any rights under this contract. This contract is between you and us. Nobody else can enforce it and neither of us will need to ask anybody else to sign-off on ending or changing it.

12.2 If a court invalidates some of this contract, the rest of it will still apply. If a court or other authority decides that some of these terms are unlawful, the rest will continue to apply.

12.3 The delay in enforcing our rights in this contract does not constitute inaction from our part. We might not immediately commence action against you for not paying or for doing something that is against the provisions set out in these terms and conditions, however we reserve the right to proceed action against you in the future subject to the Limitation Act 1953 and other relevant laws and regulations in Malaysia.

                  13. Governing Law

These terms and conditions shall be governed by and construed in all respects in accordance with the laws of Malaysia.
